01 Basis of Contract

These Conditions apply to the Contract to the exclusion of any other terms that the Customer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

Throughout this document the term "You" and "Customer" are interchangeable and for the avoidance of doubt they mean the person who intends to purchase products from Anil Celebrations.

The order constitutes an offer by the Customer to purchase the products in accordance with these Conditions. The Customer shall ensure that the terms of the order are complete and accurate.

The Contract constitutes the entire agreement between the parties. The Customer acknowledges that it has not relied on any statement, promise or representation made or given by or on behalf of Anil Celebrations which is not set out in the Contract.

Any descriptive matter or advertising issued by Anil Celebrations and any descriptions or illustrations contained in the Anil Celebrations website and catalogues are issued or published for the sole purpose of giving an approximate idea of the products described in them. They shall not form part of the Contract or any other contract between Anil Celebrations and the Customer for the sale of the products.

03 Payment and Acceptance

Anil Celebrations does not accept or process any online payment through this website. This website does not have an online payment gateway, and customers will not be asked to enter or submit credit card, debit card, UPI, net banking, or other payment details through the website.

3.1 Order Placement

When you place an order through the Anil Celebrations website, the order is treated as a request for purchase and not as confirmation of payment or final acceptance of the order.

After receiving your order, our staff will manually review and validate the order and the details provided by you.

3.2 Order Validation

Our staff will contact you, where necessary, to verify the order, product availability, quantity, pricing, delivery or collection arrangements, and other relevant details.

The order will be considered confirmed only after manual validation by Anil Celebrations. We aim to complete the order validation process within 2 business days from receipt of the order.

Placing an order through the website does not guarantee product availability or constitute final acceptance of the order until it has been manually validated and confirmed by Anil Celebrations.

3.3 Payment

After your order has been manually validated and confirmed by our staff, payment may be made using the payment method mutually agreed upon with Anil Celebrations.

The available payment method may depend on the order, delivery or collection arrangement, and other applicable circumstances. Our staff will provide the necessary payment instructions after order confirmation.

3.4 No Payment Gateway

Anil Celebrations does not currently operate or provide any payment gateway through this website.

• We do not collect credit or debit card details through this website.
• We do not collect UPI, net banking or other online payment credentials through this website.
• We do not store customers' card or banking credentials through this website.
• Customers should not enter payment card or banking information into any form on this website.
• Any payment made after order confirmation must follow the payment instructions provided by Anil Celebrations staff.

3.5 Order Cancellation or Non-Confirmation

Anil Celebrations reserves the right to decline, modify or cancel an order before confirmation, including where products are unavailable, pricing or order details require clarification, or the order cannot be fulfilled for operational or other legitimate reasons.

If an order cannot be confirmed, our staff will inform the customer accordingly.

3.6 Pricing

All product prices displayed on the website are subject to confirmation by Anil Celebrations at the time of manual order validation.

Any applicable delivery, freight, packing or other charges will be communicated to the customer before the order is confirmed.

04 Delivery and Transport

4.1 Delivery Through Customer-Selected Transport

Anil Celebrations facilitates the delivery of ordered products to the customer's preferred transport location selected during checkout.

The customer is responsible for selecting a suitable transport service and transport location that is convenient and accessible to them.

Anil Celebrations will hand over the products to the selected transport service for onward transportation to the customer.

4.2 Verification of Transport Availability

Before placing an order, customers are advised to verify with their preferred transport service that:

• The selected transport service is currently operating.
• The transport service accepts consignments for the customer's destination.
• The selected transport location is active and available.
• The transport service can transport the ordered products in accordance with applicable rules and regulations.
• The expected transportation time is suitable for the customer's requirements.

The transport location selected during checkout should therefore be a location that the customer has confirmed as available and operational.

4.3 Change of Transport Location

In certain circumstances, the transport location selected by the customer may not be available, operational, accessible, or suitable for dispatch at the time of order processing.

In such circumstances, Anil Celebrations may propose an alternative transport location.

Anil Celebrations will not change the customer's selected transport destination without informing the customer and obtaining their approval.

4.4 Festival Season and Transport Delays

During major festival seasons and peak periods, transport services may experience exceptionally high volumes of consignments.

As a result, transportation and delivery may take longer than normal.

Anil Celebrations cannot guarantee a specific transportation or delivery date where the delay is caused by the transport service, traffic conditions, festival-season congestion, weather, government restrictions, operational disruptions, or other circumstances beyond our reasonable control.

4.5 Customer Responsibility Before Ordering

Before placing an order, customers should check with their preferred nearby transport service regarding:

1. Whether the transport service is currently operating.
2. Whether the transport service accepts consignments for their destination.
3. Whether the selected transport location is available.
4. The expected transportation time.
5. Any applicable transport charges.
6. Any restrictions applicable to the transportation of fireworks or other ordered products.

Customers should select the appropriate transport location during checkout based on this information.

4.6 Transport Charges

Transport, freight or delivery charges may apply depending on the selected transport service, destination, order quantity and applicable transportation arrangements.

Where applicable, Anil Celebrations may collect the estimated or agreed transport charges from the customer as part of the order arrangement and communicate the applicable amount before the order is confirmed.

In certain cases, the transport charges may instead be payable directly to the selected transport service by the customer. The applicable payment arrangement will be communicated to the customer during order confirmation.

Transport charges may vary depending on the actual charges imposed by the transport service. Where the final transport charge differs from any estimated amount previously communicated, the customer will be informed where reasonably practicable.

4.7 Risk After Handover to Transport Service

Once the products have been handed over to the customer-selected transport service, the products are transported at the customer's risk, subject to applicable law.

Anil Celebrations will take reasonable care when packing and handing over the products to the transport service.

Anil Celebrations shall not be responsible for loss, theft, delay, damage or deterioration occurring after the products have been handed over to the transport service, except where such liability cannot legally be excluded.

4.8 Transport Delays and Circumstances Beyond Our Control

Neither party shall be in breach of this agreement nor liable for delay in performing, or failure to perform, any obligation arising from events or circumstances beyond reasonable control.

Such circumstances may include, but are not limited to, transport congestion, festival-season demand, road conditions, natural events, severe weather, government restrictions, strikes, transport service disruptions, accidents, or other circumstances affecting transportation.

Where we become aware of a significant issue affecting dispatch or transportation, we will communicate the relevant information to the customer as reasonably practicable.

4.9 Important Customer Notice

Please verify the availability and expected transportation time with your preferred nearby transport service before placing your order and select the corresponding transport location during checkout.

Selecting a transport location on the website does not by itself guarantee that the transport service will be operating or that the products will reach the customer by a particular date.

05 Cancellation of Order

At Anil Celebrations, we understand that customers may sometimes need to cancel an order. Cancellation requests are subject to the terms set out below.

5.1 Cancellation Before Payment

Customers may request cancellation of their order before making payment.

To request cancellation, the customer must send an email to anilsivakasi@gmail.com clearly mentioning their Order Number and stating that they wish to cancel the order.

5.2 Cancellation Request Processing

Cancellation requests will be reviewed by Anil Celebrations. An order cancellation will be considered effective only after the cancellation request has been acknowledged or confirmed by Anil Celebrations.

Customers should retain the cancellation email and any communication received from Anil Celebrations regarding the cancellation.

5.3 Cancellation After Payment

Once payment has been made and the order has been processed, packed or handed over for transportation, cancellation may not be possible.

Any cancellation request received after payment will be considered by Anil Celebrations based on the status of the order and the applicable refund policy.

5.4 Cancellation After Dispatch

If the products have already been handed over to the selected transport service or otherwise dispatched, the order cannot normally be cancelled.

Any request made after dispatch will be handled in accordance with the applicable refund and return terms, where applicable.

5.5 Order Not Confirmed

If an order has not yet been manually validated and confirmed by Anil Celebrations, the customer may request cancellation by email using the Order Number.

Anil Celebrations may also decline or cancel an order before confirmation where the products are unavailable, the order details cannot be verified, the selected transport arrangement is unavailable, or the order cannot otherwise be fulfilled.

06 Refund Policy

In case of quality dispute, kindly return the goods back to the showroom so that you can be entitled for refund policy.

If you are entitled to a refund, we will refund you as follows, via the payment method used at point of order within 30 days beginning with the day on which the notice of cancellation was given.

If you paid by payment card, we will refund you on the payment card used at the time of placing your order.

If you paid by cash on collection, we will refund you in person in cash or send a cheque to the value of the items purchased.

We will refund the delivery charge in full if you return all items of your order at the same time. If you choose to keep some of the items, we will retain the balance of the delivery charge that applies to the items you keep.

07 Promotional Voucher Codes and Offers

From time to time we may offer discounts using promotional vouchers or gifts or complements which are only valid during the dates specified at the time of issue.

All offers are subject to availability and while stocks last.

08 Our Responsibility to You

If we are in breach of these Terms & Conditions, Anil Celebrations will not be liable to the Customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit or indirect consequential loss arising under or in connection with the Contract.

Our products are for personal use only and our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

Clause 9 shall not limit or exclude our liability resulting from any products sold being found to cause:

• Death or personal injury caused by Anil Celebrations negligence or the negligence of its employees, agents or subcontractors.
• Defective products under the Consumer Protection Act 1987 Goods Act 1979.

Our liability to you in connection with any order will not exceed the total price paid for the items.

09 General

You may not transfer any of your rights under these Product Terms & Conditions to any other person.

A person who is not party to the Contract shall not have any rights under or in connection with it.

We may transfer our rights under these Product Terms & Conditions to another business where we reasonably believe your rights will not be affected.

If you breach these Product Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Product Terms & Conditions.

We shall not be responsible for any breach of these Product Terms & Conditions caused by circumstances beyond our reasonable control.

Except as expressly set out in these Product Terms & Conditions, all use of your personal information will be made in accordance with our Privacy Policy.

When ordering from the Anil Celebrations Site using our secure payment provider, it will only accept orders from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape.

This means you cannot inadvertently place an order through an unsecured connection.
